Terms of Use

These Terms of Service (hereinafter referred to as "the Terms") define the conditions for using the services (hereinafter referred to as "the Service") provided by KAYA Corporation (hereinafter referred to as "the Company") on this website. All registered users (hereinafter referred to as "Users") shall use the Service in accordance with the Terms.

Article 1 (Applicability)
These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.

Article 2 (User Registration)
User registration shall be completed when a prospective registrant applies for user registration in a method prescribed by the Company and the Company approves it.
The Company may not approve an application for user registration if it determines that the applicant for user registration has any of the following reasons, and the Company shall not be obligated to disclose the reasons.
(1) If false information was reported at the time of applying for user registration.
(2) If the application is from a person who has violated these Terms.
(3) In other cases where the Company deems the user registration inappropriate.

Article 3 (Management of User ID and Password)
Users shall manage their User IDs and passwords for the Service at their own responsibility.
Users may not transfer or lend their User IDs and passwords to third parties under any circumstances. If a User ID and password combination matches the registered information and a login occurs, the Company will consider the use as being made by the User who registered that User ID.

Article 4 (Usage Fees and Payment Method)
Users shall pay the usage fees separately determined by the Company and displayed on this website, in the method designated by the Company, as consideration for using the Service.

Article 5 (Prohibited Actions)
Users must not engage in the following actions when using the Service:
(1) Actions that violate laws or public order and morals.
(2) Actions related to criminal acts.
(3) Actions that destroy or interfere with the functions of the Company's servers or networks.
(4) Actions that may interfere with the operation of the Company's services.
(5) Actions that collect or accumulate personal information of other users.
(6) Actions that impersonate another user.
(7) Actions that directly or indirectly provide benefits to anti-social forces in connection with the Company's services.
(8) Other actions that the Company deems inappropriate.

Article 6 (Suspension, etc., of Service Provision)
If the Company determines that any of the following events has occurred, it may suspend or interrupt the provision of all or part of the Service without prior notice to the User.
(1) When performing maintenance, inspection, or updating of the computer system related to the Service.
(2) When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
(3) When computers or communication lines stop due to an accident.
(4) In other cases where the Company determines that the provision of the Service is difficult.
The Company shall not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the Service, regardless of the reason.

Article 7 (Usage Restrictions and Registration Deletion)
In the following cases, the Company may, without prior notice, restrict the use of all or part of the Service for a User, or delete the User's registration.
(1) If there is a violation of any provision of these Terms.
(2) If it is found that there is false information in the registered details.
(3) In other cases where the Company deems the use of the Service inappropriate.
The Company shall not be liable for any damages incurred by the User due to actions taken by the Company based on this Article.

Article 8 (Disclaimer)
The Company shall be exempt from liability for default unless it is due to the Company's willful misconduct or gross negligence.
Even if the Company is liable for any reason, it shall only be liable for damages within the scope of ordinary damages and, in the case of paid services, within the amount of the consideration (or the equivalent of one month's worth in the case of continuous services).
The Company shall not be responsible for any transactions, communications, or disputes that arise between the User and other users or third parties regarding the Service.

Article 9 (Changes to Service Content, etc.)
The Company may change the content of the Service or discontinue the provision of the Service at any time without notifying the User, and shall not be liable for any damages incurred by the User as a result.

Article 10 (Changes to Terms of Service)
If the Company deems it necessary, it may change these Terms at any time without notifying the User.

Article 11 (Notices or Communications)
Notices or communications between the User and the Company shall be made by the method specified by the Company.

Article 12 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their position under the service agreement or their rights or obligations based on these Terms to a third party, or offer them as collateral, without the prior written consent of the Company.
Article 13 (Governing Law and Jurisdiction)

Japanese law shall be the governing law for the interpretation of these Terms.
In the event of a dispute concerning the Service, the court having jurisdiction over the location of the Company's head office shall be the exclusive agreed jurisdiction.
